Big Brother Is Watching You: The New Jersey Legislature recently enacted a law establishing a pilot program to install cameras at intersections for the purpose of issuing traffic summonses remotely to New Jersey drivers.  A similar program was established in New York in the wake of 9-11, which gives an aggrieved driver the option of paying the ticket (currently $50.00) or taking the day off from work and traveling to the city to spend the day in a hearing room.  You must appear in order to contest the charge.

No Liability to Fans:   The New Jersey Supreme Court has just ruled in the case of Sciarrotta v. Global Spectrum that if a sports arena provides protective screening in the most dangerous spectator areas  and provides additional protected seating for those who request it, it has no liability to a fan who may be injured by a flying puck or ball, even during warmups.     

Statute of Limitations: The New Jersey State Bar Association has published a draft of its bill to reduce the time period that a client has to sue his attorney for legal malpractice from six years to two years.  The bill would also prohibit fee awards to successful legal malpractice plaintiffs.  It is unclear whether the Legislature will enact this proposal into law.

          It is hard to believe it but the Law Offices of Charles D. Whelan III first opened for business in January 1988.  Mr. Whelan was admitted to practice law in 1981 and following a judicial clerkship, worked for a civil litigation firm for five years before striking out on his own.  After all of these years, our mission has not changed:  providing the best possible legal services at a reasonable cost.

For 19 years now, Chuck Whelan has served as pro bono counsel for Greater Plainfield Habitat for Humanity Inc., a community based organization dedicated to providing affordable housing ownership opportunities to qualified families. Legal services provided have including acquisition of land and existing structures, creation of a condominium ownership regime, applications for zoning and planning board approvals, preparation of mortgage and sale documents, conducting real estate closings on conveyances to Habitat participants, and general corporate and litigation advice and counseling. The most rewarding part of this process is that at the end of the day, a deserving family gets a new home, and the community as a whole is improved as a result.
